Welcome to S’more AI. These Terms govern your use of the S’more AI platform (“Service”), designed for restaurant operators and hospitality businesses.
1. Use of Service
S’more AI provides tools for running and managing automated sales contests, staff engagement, and revenue analytics. You may only use the Service for lawful business purposes related to your restaurant or hospitality operations.
2. Accounts & Access
You must provide accurate business and contact information. You are responsible for keeping your login credentials secure and for all activity under your account.
3. Subscriptions & Payment
Access to the Service may require a paid subscription. Pricing and terms are provided at sign-up. Fees are billed on a recurring basis unless canceled. Payments are non-refundable except as required by law.
4. Customer Data
You own all business and employee data you provide to S’more AI. You grant us a limited license to use this data solely for operating and improving the Service. We do not sell customer or employee data.
5. SMS Communications
By using S’more AI, you may opt in to receive SMS text messages related to contests, updates, and rewards. Message frequency varies by contest or engagement program. Standard messaging and data rates may apply. You can opt out at any time by replying “STOP” to any message. For help, reply “HELP” or contact our support team at support@smoreai.com . By opting in, you consent to receive automated messages from S’more AI for operational purposes. Consent is not a condition of purchase.
6. Acceptable Use
You agree not to:
- Interfere with or disrupt the Service.
- Misuse the Service to run fraudulent or abusive contests.
- Attempt to reverse-engineer, copy, or resell the software.
7. Intellectual Property
All rights to the S’more AI platform, branding, and technology remain with us. Your subscription grants you a limited, non-transferable right to use the Service during your active subscription term.
8. Disclaimers
The Service is provided “as is.” We make no guarantees that contests, insights, or analytics will result in specific financial outcomes.
8. Limitation of Liability
S’more AI’s liability is limited to the maximum extent permitted by law and shall not exceed the total amount you paid for your subscription during the twelve (12) months preceding the claim.
9. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any disputes arising from or relating to these Terms shall be resolved exclusively in the courts located in Lake County, Florida.
